1. Who does what
- The organiser sells your ticket and runs the event. Your contract to attend the event is with the organiser named on the event page. The organiser is responsible for the event, and for refunds when an event is cancelled or changed.
- A.C.N. 698 111 223 PTY LTD (ACN 698 111 223, ABN 93 698 111 223), trading as GATE98 ("GATE98", "we") provides the platform that takes your booking and payment. We charge a booking fee for that service. We are not the organiser, and we do not hold your money: your payment goes to the organiser's payment account through our payment provider, Stripe.
- Refunds come from the organiser's payment account. The organiser decides, or is required by this policy, to give a refund, and makes it through our platform or asks us to make it for them. Where this policy says the booking fee is refunded, it comes back with the refund, also from the organiser's payment account. We are not responsible for an organiser's failure to refund, but section 10 explains what we will do to help.
2. If an event is cancelled
- If the organiser cancels the event, you are entitled to a full refund of the ticket price, including any GST charged on it.
- You will also get back the booking fee (see section 7).
- You do not need to ask. Once the organiser cancels the event, we email you, and every affected order is refunded in full, promptly and in any event within 10 business days. If you have not been refunded after that, contact us (section 12).
- If an event is cancelled in part (for example, one day of a multi-day event), you are entitled to a refund of the part not delivered.
3. If an event is significantly changed
A change is significant if a reasonable person would not have bought the ticket, or would have bought it on different terms, had they known. These are treated as significant:
| Significant | Not significant |
|---|---|
| Change of venue to a different venue or suburb (not a different room in the same venue) | A change to doors-open or set times that does not affect most people's ability to attend |
| Change of event date | Support acts changing, where the headline act is unchanged |
| Headline act or main advertised attraction removed or replaced | Minor changes to the layout, catering or facilities |
| Event shortened by a large part, or its nature materially changed | Changes outside the organiser's control that do not affect what was advertised |
| Age restriction or ticket type materially changed |
The organiser must tell ticket holders about a significant change as soon as practicable, and in any event within 2 business days, of deciding on it. When the change is to the event's date, time or venue, we email ticket holders as soon as the organiser makes it. If you can no longer attend because of a significant change, you can ask for a full refund of the ticket price (including GST) and the booking fee, as in section 5.
4. If an event is postponed or rescheduled
- We email you when the event is postponed, and again when the new date is set.
- Your ticket stays valid for the new date. If the organiser offers a different option instead, it must be at least as good.
- If you cannot attend the new date, you can ask the organiser for a full refund of the ticket price (including GST) and the booking fee.
- If a new date has been announced, you must ask within 30 days of being told the new date.
- If no new date has been announced yet, you can ask for a refund at any time until one is.
5. How to ask for a refund after a change or postponement
- Reply to your order confirmation email, or use the "Contact the host" form on the event page, saying which order and why.
- The organiser must reply within 5 business days. If a refund is due, it will be issued, including the booking fee, promptly and in any event within 10 business days of your request.
- If you get no answer, contact us (section 12). We will follow up with the organiser.
6. Change of mind
If you simply cannot attend, or have changed your mind, you are not entitled to a refund unless the organiser's event page says otherwise. If the organiser offers refunds or exchanges, they will say so on the event page, together with their deadlines and any fee. The booking fee is not refunded in these cases.
7. What is and is not refunded
We list each amount separately so there is no ambiguity.
| Amount | Cancelled or significantly changed event | Postponed, and you cannot attend | Change of mind |
|---|---|---|---|
| Ticket price | Refunded | Refunded | Only if the organiser's policy allows |
| GST on the ticket (if the organiser charges GST) | Refunded with the ticket | Refunded with the ticket | With the ticket, if refunded |
| Booking fee (incl. GST) | Refunded | Refunded | Not refunded |
| Payment processing fee | Not refunded to you; it is not charged to you separately. It is a cost to the organiser | Same | Same |
The booking fee is the amount we charge for facilitating your booking. When the organiser fails to deliver the event as advertised, you should not be out of pocket for it, so the organiser refunds it to you. When you cancel by choice, the service has already been provided, so it is not refunded.
The booking fee is charged once per order, so each ticket carries an equal share of it. If only some tickets in your order are refunded, or part of your order was already refunded for another reason (such as a change of mind), the booking fee is refunded only for the tickets the cancellation, change or postponement affects: their equal share of it.
8. Events affected by circumstances outside anyone's control
Events can be disrupted by government restrictions, severe weather, natural disasters, public health orders, or safety emergencies. In those cases:
- If the event does not go ahead, it is a cancellation (section 2), whatever the cause.
- If it goes ahead in a changed form, section 3 applies.
- GATE98 does not offer credits or vouchers. Where you are entitled to a refund, you get a refund. An organiser may offer you something else, such as a place at a later event, but only if you freely choose it instead of a refund. That arrangement is between you and the organiser, not GATE98, and if it is not honoured you are still entitled to your refund.
Nothing in this section limits your rights under the Australian Consumer Law (section 11).
9. How and when you receive your refund
- Refunds go back to the original payment method. We cannot refund to a different card or account.
- Once a refund is issued, it usually appears within 5 to 10 business days, depending on your bank or card issuer. Banks, not GATE98, control that timing.
- You will receive an email when the refund is issued.
- If the organiser's payment account does not have enough funds to cover a refund, the refund may be delayed or fail while the organiser resolves it. We are not required to fund refunds ourselves. If this happens, contact us.
10. If the organiser does not refund you
We process the refunds that organisers owe, but we are not responsible for an organiser's failure to pay one. If an organiser has not refunded you within the times in this policy, contact us and we will:
- Contact the organiser and ask them to refund you.
- If they do not, where we are able to, refund you on the organiser's behalf and recover that cost from the organiser, and take action against the organiser's account under the Organiser Terms, such as suspending their events or pausing their payouts.
- Tell you what we have done.
If your payment was made by card, you may also be able to dispute the charge with your bank. We encourage you to contact us first.
11. Your rights under Australian law
Nothing in this policy, the event page or the organiser's terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), including the consumer guarantees. For example, if an event is not provided with due care and skill, or does not match its description, you may be entitled to a remedy such as a refund. This policy sets out what we and organisers commit to at a minimum. Where the law gives you more, you get more.
12. Time limits, notices and contact
- Time limit. For a cancelled event no request is needed. For a significant change or postponement, request within the time in section 4. For anything else, contact us as soon as you can. Delay may make it harder to resolve, but no time limit in this policy restricts your rights under the law.
- Where you will be told. We email ticket holders at the address used at purchase when an event is cancelled or postponed, when a postponed event's new date is set, and when its date, time or venue changes significantly. The organiser must tell you about any other significant change by email to that address. The event page always shows the event's current date, time and venue. We may also email you.
- Contact. support@gate98.co or the "Contact the host" form on the event page. Please quote your order number.
13. Changes to this policy
We may update this policy. Your ticket is governed by the version in force when you bought it. A later change will not reduce your entitlement for that purchase, although you may take the benefit of a change that is better for you.
14. No guarantee
This policy is not insurance and does not guarantee the performance of any organiser. It sets out the rights described above.
