These terms apply when you buy a ticket through GATE98. They are between you and A.C.N. 698 111 223 PTY LTD (ACN 698 111 223, ABN 93 698 111 223), trading as GATE98 ("GATE98", "we", "us"). By ticking the box at checkout and paying, you accept them. They include our Refund Policy (https://www.gate98.co/refunds) and our Privacy Policy (https://www.gate98.co/privacy).
1. Summary
This summary is a guide only; the clauses below are what apply.
- The event organiser sells you the ticket and runs the event. GATE98 is the platform that takes your booking and payment.
- Your ticket is a PDF emailed to you, with a QR code. The first valid scan gets in. A copy is not a second ticket.
- Tickets cannot be resold, at any price. You may give a ticket away free.
- If an event is cancelled or significantly changed, you are entitled to a refund under the Refund Policy. If you simply change your mind, you generally are not.
- Nothing here takes away your rights under Australian consumer law.
2. Who you are dealing with
2.1 The organiser is the seller. The organiser named on the event page offers the ticket and runs the event. Your contract to attend the event is with the organiser. The organiser is responsible for the event, including its content, safety, venue, licences and any changes.
2.2 We are the platform. We provide the booking, payment and ticketing technology and charge a booking fee for it (clause 5). We are not the organiser, promoter or venue operator. We do not control events and do not guarantee that any event will take place or be as described.
2.3 Payment goes to the organiser. We do not hold your payment. It is taken by our payment provider, Stripe, and paid to the organiser's account, less our booking fee.
3. Who can buy
3.1 You must be at least 18 to buy a ticket. If you are under 18, a parent or guardian must buy for you.
3.2 You must give correct details, including a valid email address, because your tickets are sent there. You must have the right to use the payment method you choose.
3.3 An event may have its own age limit or entry conditions, set by the organiser. These apply to who may attend, in addition to this clause.
4. Buying a ticket
4.1 Holding tickets. When you select tickets we hold them for you for a short time (currently 10 minutes), shown by a timer at checkout. If the timer runs out, the hold is released and the tickets may be sold to someone else. A hold is not a purchase.
4.2 Price. The total you pay is shown before you pay. It is made up of the ticket price, any GST the organiser charges on it, and our booking fee (clause 5). Prices are in Australian dollars. We do not add a surcharge for paying by card.
4.3 Payment. Payment is processed by Stripe. Stripe's terms apply to the payment. You authorise the amount shown to be charged to your payment method.
4.4 When your order is complete. Your order is accepted, and a contract is formed, when your payment succeeds and we send you an order confirmation. If the payment fails or is not completed, there is no order.
4.5 Receipt. We email you a receipt. If the organiser is registered for GST, the receipt is a tax invoice in the organiser's name. The booking fee is shown as our charge, with our ABN.
5. Booking fee
5.1 We charge a booking fee on each order, plus GST. It is shown to you before you pay and is included in the total. An order of only free tickets has no booking fee.
5.2 The booking fee is for the service of making your booking and issuing your tickets. It is refunded only in the situations set out in the Refund Policy, and otherwise is not refundable.
6. Your tickets
6.1 Delivery. After payment we email your order confirmation, a receipt (PDF) and your tickets (PDF) to the email address you gave. Please check your spam or junk folder. You are responsible for giving a correct address.
6.2 If you do not receive them. Contact the organiser using the "Contact the host" form on the event page, or contact us at support@gate98.co with your order number. The organiser can resend your tickets, and we will help.
6.3 The QR code is the ticket. Each ticket has a unique QR code. Keep it private. Do not share a photo or copy of it with anyone you do not intend to admit.
6.4 Entry. The first valid scan of a QR code admits entry. A copy of a ticket is not a second ticket. If a code has already been scanned, the organiser may refuse entry, whoever presents it. A refunded ticket is no longer valid.
6.5 Entry is not guaranteed. The organiser decides who is admitted, and may refuse entry or remove a person who breaches the event's conditions, is intoxicated or is unsafe, or who does not meet an age limit. If you are refused for your own breach, you are not entitled to a refund. Your statutory rights are not affected.
7. The event, its conditions and changes
7.1 The event information (date, time, venue, line-up, price and conditions of entry) is provided by the organiser. We display it but do not verify it.
7.2 The organiser may set conditions of entry in the event description. They apply to you in addition to these terms. If an organiser's condition conflicts with these terms or the Refund Policy, the one more favourable to you applies, to the extent the law allows.
7.3 If an event is cancelled, significantly changed or postponed, the Refund Policy sets out your entitlement and how to claim it. Organisers must tell ticket holders by email to the address you gave us.
8. Refunds
Our Refund Policy applies to every ticket. If these terms and the Refund Policy differ on refunds, the Refund Policy prevails. In short: if an event is cancelled or significantly changed you are entitled to a refund of the ticket price (and GST on it) and the booking fee. If you can no longer attend a postponed event, you can ask for the same. For a change of mind, you are not entitled to a refund unless the organiser says otherwise, and the booking fee is not refunded. Nothing in these terms limits your rights under Australian law (clause 14.1).
9. Resale and transfer
9.1 Tickets are not for resale. You must not sell, auction or exchange a ticket for money or any other value, at any price (including the price you paid), or offer one for resale, on any website, app, social media or otherwise. You must not buy a ticket in order to resell it.
9.2 No transfer or name change. Tickets are PDFs and the platform does not currently offer a way to transfer a ticket or change the name on it.
9.3 Gifting. You may give a ticket to another person free of charge, unless the event description says otherwise. If you do, you pass on the ticket's QR code, and you can no longer attend with it yourself.
9.4 Our rights. We or the organiser may cancel or void any ticket we reasonably believe has been resold or offered for resale in breach of this clause or the law, and refuse entry on it. We may, at our discretion and subject to the law, refund the person who bought it from us. Tickets sold or offered through unauthorised sellers may be invalid, and neither we nor the organiser are liable for them.
9.5 Many States and Territories have laws about ticket resale. You must comply with them.
10. Acceptable use and suspicious orders
10.1 You must not: use bots, scripts or automated tools to buy tickets or hold inventory; place orders you intend to resell; give false or misleading details; use a payment method you are not entitled to use; abuse the chargeback process; interfere with or probe the platform; or use it in a way that is unlawful or harms others.
10.2 We or the organiser may cancel an order, void its tickets and refuse future orders if we reasonably believe it breaches these terms or the law, or involves fraud. If we do, we will refund the amount you paid for the cancelled order, unless the law allows or requires us to do otherwise.
10.3 Organisers may set limits on the number of tickets per person or order in the event description. Orders that exceed a stated limit may be cancelled and refunded.
11. Your information
11.1 What we collect. At checkout we collect your name, email address and (optionally) phone number, and details of your order. We also record that you accepted these terms. Our Privacy Policy explains how we handle this information and your rights.
11.2 How we use it. To process your order and payment, send your tickets, receipts and service messages, provide support, prevent fraud, and meet legal obligations.
11.3 Who sees it. We share your name, email address and phone number (if given) with the organiser of your event, so they can run the event and contact you about it. Organisers must use your information only for the event and as the privacy laws and our terms allow. We also share it with service providers that help us deliver the service, such as our payment provider (Stripe) and our email delivery provider. If you use "Contact the host" on an event page, the details you enter and your message are sent to the organiser.
11.4 Marketing. GATE98 sends you only order and service emails (such as your tickets, receipt, refund or event changes). We do not send you marketing. An organiser may send you marketing only if you have agreed to receive it, and must let you unsubscribe.
12. Payment disputes
If you have a problem with a charge, please contact us first so that we can help. You may also dispute a charge with your bank. Please do not dispute a charge for a ticket you have used or for an event that took place as advertised: that is an abuse of the chargeback process, and we may refuse future orders.
13. Complaints and contact
Contact us at support@gate98.co, quoting your order number. We will reply within 5 business days. Issues with an event itself, such as its content or what happened there, should also be raised with the organiser using the "Contact the host" form.
14. Our responsibility
14.1 Your rights under Australian law. Nothing in these terms, the Refund Policy or an event page excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, including the consumer guarantees.
14.2 The organiser's events. Subject to clause 14.1, we are not responsible for the event, the organiser, performers, the venue or other attendees, or for the organiser's failure to give a refund. The Refund Policy explains what we will do to help if an organiser does not.
14.3 The platform. We provide the platform with due care and skill, but we do not promise that it will always be available or error-free.
14.4 Exclusions. Subject to clause 14.1 and to the maximum extent the law allows, we are not liable for any indirect or consequential loss, or for loss of opportunity or enjoyment that is not caused by our own breach.
14.5 Events outside our control. We are not liable for a delay or failure caused by events beyond our reasonable control. This does not limit any refund you are owed.
15. Changes to these terms
We may change these terms. Your ticket is governed by the version in force when you bought it. A later change will not reduce your entitlements for that purchase, although you may take the benefit of a change that is better for you.
16. General
16.1 These terms, the Refund Policy, the Privacy Policy and the event conditions are the whole agreement about your purchase.
16.2 These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland. Nothing here limits any right you have to bring a claim elsewhere under consumer law.
16.3 If a provision is unenforceable it is read down or removed and the rest continues. A failure to enforce a right is not a waiver. You may not transfer your rights under these terms. This agreement may be accepted electronically.
